Acceptance of Terms

By downloading, installing, or using FlashVibe ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Description of Service

FlashVibe is a flashcard learning application that allows users to:

• Create and organize flashcards
• Study and review learning materials
• Track learning progress and achievements
• Share and collaborate on learning content
• Access educational resources and tools

User Accounts

To use certain features of the App, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

FlashVibe is rated 4+ on the App Store and suitable for young learners. If the user is under the age of 13, account creation and any personal data submission should be performed with a parent or guardian’s permission and oversight, consistent with applicable laws.

User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Upload or share inappropriate, offensive, or harmful content
• Attempt to gain unauthorized access to the App or other users' accounts
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App without permission
• Violate any applicable laws or regulations

Content and Intellectual Property

Your Content:

You retain ownership of content you create and share through the App. By sharing content, you grant us a license to display and distribute it within the App.

Our Content:

The App, including its design, features, and functionality, is owned by us and protected by intellectual property laws.

Third-Party Content:

The App may contain content from third parties. We are not responsible for such content.

Subscriptions and In-App Purchases

FlashVibe offers subscription services and in-app purchases. These purchases are subject to:

• Apple's Standard Terms of Use (EULA): All App Store purchases, including subscriptions, are governed by Apple's Licensed Application End User License Agreement, available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase
• Management: You can manage and cancel subscriptions in your device's Account Settings after purchase
• Refunds: Refund requests are subject to Apple's refund policy

Privacy and Data

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App or servers are free of viruses or other harmful components
• Results obtained from using the App will be accurate or reliable

Termination

We may terminate or suspend your account and access to the App at any time, with or without cause, with or without notice.

You may terminate your account at any time by contacting us or using the account deletion feature in the App.

Upon termination, your right to use the App will cease immediately.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms in the App
• Updating the "Last updated" date
• Sending you a notification for significant changes

Your continued use of the App after changes constitutes acceptance of the updated Terms.
